Terms of Service for MyMotif

These Terms of Service ("Terms") form a binding agreement between you and Tally1, LLC, a Wyoming limited liability company ("Tally1", "we", "us", or "our"). They govern your use of the MyMotif mobile application, the website at mymotif.io, and the optional companion experience at motif-match.com (collectively, "MyMotif" or the "Service").

Please read these Terms carefully. Section 15 contains an arbitration clause and a class action waiver that affect your legal rights, including how disputes are resolved. You have the right to opt out of arbitration within 30 days of account creation.

In plain English: These are the rules for using MyMotif. By signing in, you agree to them. If you ever want to leave, you can delete your account at any time. How we handle your information is covered separately in our Privacy Policy.


1. Acceptance of Terms

In plain English: When you sign in to MyMotif, you are agreeing to this document.

By signing in to MyMotif, or by using MyMotif in any other way, you accept these Terms and our Privacy Policy. If you do not accept these Terms, do not use MyMotif.

We may change these Terms from time to time as described in Section 10. Your continued use of MyMotif after a change constitutes acceptance of the revised Terms.

2. Who can use MyMotif

In plain English: You must be 18 or older, legally able to enter into this agreement, not on a US sanctions list, and located in the United States or Canada.

To use MyMotif, you must:

  1. Be 18 years of age or older.
  2. Have the legal capacity to enter into a binding contract in your jurisdiction.
  3. Not be prohibited from using MyMotif under applicable law, including US government sanctions or embargo lists.
  4. Be located in a geography where MyMotif is available. At launch, MyMotif is available in the United States and Canada. We may expand availability over time.

3. Your account

In plain English: You can use MyMotif as a guest for up to 30 days, or sign up with Apple, Google, or email for a permanent account. Keep your account secure. You are responsible for what happens on it. We can suspend an account that is being abused or misused. Deletion is described in our Privacy Policy.

You may use MyMotif in one of two ways:

You are responsible for maintaining the security of your identity provider credentials and any device through which you access MyMotif. You are responsible for all activity that occurs under your account, whether or not authorized by you. Notify us at privacy@mymotif.io promptly if you believe your account has been accessed without your permission.

3.3 Suspension and termination by us

We may suspend or terminate your account if we reasonably believe you have violated these Terms, if continued access would pose a risk to the Service or other users, or if required by law. Where reasonable, we will give notice first.

4. How MyMotif works

In plain English: Every day, all users see the same sixteen images. You tap four of them and we build a collage and show you a quote. That is the whole experience. We do not promise you will see any specific image, any specific quote, or feel any specific way.

Each day, MyMotif presents all users worldwide with the same 16 images, arranged in four grids of four. You tap one image in each grid. From your four selections we generate a collage and deliver a quote. The experience is designed to last less than 30 seconds. MyMotif does not guarantee that any particular image, quote, emotional response, or outcome will be produced. MyMotif is offered for enjoyment and reflection, and you rely on it at your own discretion.

5. Your content

In plain English: Your comments stay private with us, but you give us permission to use them anonymously to improve and talk about MyMotif. Your collages are yours to share. If you share your day to motif-match.com, we only send the number of the day and a signature of your selections, no text, no personal data.

5.1 Your comments

When you submit a comment through the comment icon on the collage screen, you send private feedback to Tally1. Your comments are not published publicly within MyMotif or on motif-match.com. You grant us a non-exclusive, royalty-free, worldwide license to use your comments to operate, improve, and promote MyMotif, including the right to quote your comments in anonymized form in marketing materials (for example: "This app made my morning better, from a MyMotif user"). If we would like to attribute a specific comment to you by first name, social handle, or city, we will contact you first and obtain your explicit permission.

5.2 Your shared collages

You may export or share your collage through your device's standard sharing options, or by any other means you choose. When you share a collage to another platform (such as a social network or a messaging app), your use of that platform is governed by the platform's own terms. You are responsible for complying with those terms when you share MyMotif content.

5.3 MotifMatch opt-in

motif-match.com is an elective companion experience. You may opt in by choosing to share your daily result to motif-match.com. When you do, we transmit only your day number (dayNumber) and your selection signature (selectionSignature). We do not transmit your comments, your identity, or any personal data. Your opt-in is session-by-session; you can decline at any time.

6. Our content and your collage

In plain English: The collage you create is yours to keep, share, print, and use. The individual images and quotes inside the collage come with their own licenses, and those licenses still apply if you separate the pieces from the collage.

The collage you generate from your daily selections is yours to keep, share, print, and use for personal and commercial purposes. The underlying images and quotes remain subject to the licenses under which MyMotif sources them (currently Unsplash, Pexels, and Adobe Stock for images, and the public domain for quotes), which generally permit this use. If you separate individual images or quotes from your collage, you are responsible for complying with their underlying licenses. From time to time, MyMotif may include licensed content (such as quotes from contemporary authors or photographs submitted by other users); if your collage contains such licensed content, its use may be subject to additional restrictions, which we will disclose in-app when applicable.

Other than the rights described above, MyMotif, including its software, design, images selection, and branding, is owned by Tally1 and its licensors. No license is granted to you other than what is expressly described here or in the underlying content licenses.

7. Attribution of third-party content and services

In plain English: MyMotif uses images from Unsplash, Pexels, and Adobe Stock, quotes from the public domain, sign-in services from Apple and Google, and AI assistance from Anthropic. Their brands belong to them.

MyMotif includes content and services provided by third parties, whose trademarks, names, and intellectual property remain theirs:

8. Prohibited conduct

In plain English: Don't try to break MyMotif, scrape its data, cheat the experience, impersonate other people, figure out who other users are, or use MyMotif to train competing AI.

You agree not to:

  1. Reverse engineer, decompile, or disassemble MyMotif except to the extent permitted by applicable law
  2. Scrape, crawl, or harvest MyMotif data or content by automated means
  3. Circumvent or attempt to circumvent any technical protection or access control in the Service
  4. Use MyMotif in any way intended to manipulate results, inflate session counts, or otherwise cheat the intended experience
  5. Use MyMotif to train any machine learning model that competes with MyMotif or its licensors
  6. Impersonate any person or entity, or misrepresent your affiliation with a person or entity
  7. Attempt to identify, deanonymize, or contact other MyMotif users based on their Service activity
  8. Use MyMotif in any way that violates applicable law, infringes any third party's rights, or risks harm to MyMotif, Tally1, or other users

In plain English: motif-match.com is a related service covered by these Terms. App stores have their own rules too.

motif-match.com is a related service operated by Tally1 and governed by these Terms. Your use of MyMotif through an app store (such as the Apple App Store or Google Play) is also subject to the app store's terms. If those terms conflict with these Terms, the app store's terms control only to the extent required by that app store.

10. Changes to the app and to these Terms

In plain English: MyMotif will evolve over time. If we make meaningful changes to these Terms, we will notify you inside the app before the changes take effect.

We may update, change, suspend, or discontinue any part of MyMotif at any time, including these Terms. For material changes to these Terms we will provide prominent notice inside MyMotif at least seven (7) days before the change takes effect, and we will update the "Last updated" date at the top of this document. If you continue to use MyMotif after the effective date of a revised Terms, you accept the revised Terms. If you do not accept them, you may stop using MyMotif and delete your account.

11. Termination

In plain English: You can leave any time by deleting your account. We can suspend or terminate accounts that break the rules. Some parts of these Terms continue to apply even after termination.

You may terminate your account at any time via the in-app "Delete Account" option in the App Menu, or by emailing privacy@mymotif.io.

We may suspend or terminate your account as described in Section 3.3. Upon termination, your right to use MyMotif ends immediately. Sections 5.1 (comment license, surviving for content already submitted), 6 (Our content and your collage), 8 (Prohibited conduct), 12 (Disclaimers), 13 (Limitation of liability), 14 (Indemnification), 15 (Dispute resolution), 16 (Governing law), and 17 (Miscellaneous) survive termination.

12. Disclaimers

In plain English: MyMotif is offered as-is. It is not therapy, it is not a medical device, and it is not a substitute for professional help. If you are in crisis, please reach out to a professional or call or text 988.

MyMotif is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Tally1 disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. Tally1 does not warrant that MyMotif will be uninterrupted, secure, or error-free, or that the content you see will be accurate, reliable, or suited to your circumstances.

MyMotif is a wellness-adjacent product designed for reflection and enjoyment. It is not a medical device, mental health service, therapy tool, or substitute for advice from a qualified healthcare provider. If you are experiencing a mental health crisis, please contact a qualified professional or, in the US and Canada, call or text 988 for the Suicide & Crisis Lifeline.

13. Limitation of liability

In plain English: If something goes wrong and we are at fault, our total liability to you is capped at the greater of $100 or what you have paid us in the past year. We are not liable for indirect damages like lost profits.

To the maximum extent permitted by law, Tally1 and its officers, directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or substitute services, arising out of or in connection with MyMotif, whether based on contract, tort, strict liability, or any other theory, even if Tally1 has been advised of the possibility of such damages.

Tally1's total liability to you for all claims arising out of or relating to MyMotif will not exceed the greater of one hundred United States dollars ($100) or amounts you have paid to Tally1 in the preceding twelve (12) months.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations in this section apply to the maximum extent permitted by law.

14. Indemnification

In plain English: If someone sues us because of how you misused MyMotif or what you sent us, you agree to cover the reasonable costs.

You agree to defend, indemnify, and hold harmless Tally1 and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of MyMotif; (b) your content, including comments you submit; (c) your violation of these Terms, including the Privacy Policy; or (d) your violation of any third-party right, including intellectual property or privacy rights.

15. Dispute resolution; arbitration; class action waiver

In plain English: If we have a dispute, we will try to resolve it privately through arbitration, not in court. You can opt out of arbitration within 30 days of creating your account by emailing us. Class actions are waived. Small-claims court is still available.

Please read this section carefully. It affects your legal rights.

15.1 Agreement to arbitrate

Except as provided below, any dispute arising out of or related to these Terms or to MyMotif will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at www.adr.org. The arbitration will be seated in Casper, Wyoming, although you may elect to participate by phone or video at no additional cost to you. The arbitrator may award any individual relief available under applicable law.

15.2 Class action waiver

You and Tally1 each agree that any dispute will be resolved on an individual basis only, not as a class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If a court or arbitrator finds this class action waiver unenforceable for any reason, the entire arbitration agreement in this Section 15 will be null and void, but the remainder of these Terms will remain in effect.

15.3 30-day right to opt out of arbitration

You may opt out of the arbitration agreement in Section 15.1 and the class action waiver in Section 15.2 by sending written notice to privacy@mymotif.io within 30 days of your account creation. Your notice must include: (i) your name, (ii) the email address associated with your account, and (iii) a clear statement that you wish to opt out of arbitration. Opting out does not affect your access to MyMotif, and we will not retaliate against you for opting out.

15.4 Exceptions

Nothing in this Section 15 prevents either party from: (a) bringing an individual claim in small-claims court if the claim qualifies; or (b) seeking injunctive or equitable relief in court to stop unauthorized use or abuse of the Service or to protect intellectual property rights.

15.5 Informal resolution

Before initiating arbitration or a small-claims action, you agree to first contact us at privacy@mymotif.io with a written description of the dispute and the relief you seek, and to allow us 60 days to try to resolve the matter informally.

16. Governing law

In plain English: Wyoming law applies. Cases that are not sent to arbitration are heard in Casper, Wyoming.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any claim not subject to arbitration under Section 15 will be brought exclusively in the state or federal courts located in Casper, Wyoming, and you and Tally1 consent to the personal jurisdiction of those courts.

17. Miscellaneous

In plain English: Standard closing provisions: if one part is invalid, the rest stands; this document (plus the Privacy Policy) is the entire agreement; we can assign this to a new owner if MyMotif is sold; you cannot; let us know if you need to reach us.


These Terms are written in English. If they are translated into another language and there is any inconsistency, the English version controls.
